The guideline from the HOC Reference Guide (Hazards and nuisances 1-18) states and also reaffirrmed in HUD’s frequently asked questions.
Items needed to prove property is located outside easement:
“If the dwelling and related property improvements are located outside the easement, the property is considered eligible and no further action is necessary.”
1. Plat of Survey showing High Voltage Lines Easement
2. Survey showing location of home and improvements (such as a garage, pool etc..) are located outside of easement.
If property is located within the easement:
“If the dwelling or related property improvement is located within such an easement, the DE Underwriter must obtain a letter from the owner or operator of the tower indicating that the dwelling and its related property improvements are not located within the tower’s (engineered) fall distance in order to waive this requirement.”
1. Get letter from owner of power lines stating that home is not located under lines.
2. Seek a waiver from HUD HOC – lender will be required to obtain.
